1. Introduction
Welcome to Four Seasons Hosting, a provider of web hosting, game server, and related services (the “Services”). These Terms of Service (the “Terms”) govern your use of the Services, including any content, functionality, and services offered on or through www.fourseasonshosting.com (the “Website”). Four Seasons Hosting, LLC, an Ohio limited liability company (“Four Seasons Hosting,” “we,” “us,” or “our”), provides these Services to you subject to these Terms.
2. Acceptance of Terms
By accessing or using the Services, you agree to be bound by these Terms and all applicable laws and regulations. If you do not agree to these Terms in their entirety, you are prohibited from using the Services and must discontinue use immediately.
3. Description of Services
3.1. Four Seasons Hosting provides a variety of hosting services, including game server hosting, Virtual Private Server (“VPS”) hosting, web hosting, and reseller hosting.
3.2. All Services are provided on a commercially reasonable efforts basis. While we strive to maintain consistent and reliable service, we do not guarantee that the Services will be available without interruption, delay, or error, except as set out in our Service Level Agreement (“SLA”).
3.3. Four Seasons Hosting reserves the right to modify, suspend, or discontinue any aspect of the Services at any time, with or without notice.
4. Payment, Renewal & Refunds
Payment Terms
4.1. Payment for the Services is due on the date indicated on the invoice. If payment is not received by the due date, Four Seasons Hosting reserves the right to suspend or terminate your account without further notice.
4.2. Services will automatically renew at the end of the subscription period at the then-current rates, unless you cancel prior to the renewal date through your account portal or by contacting support.
Domain Registration
4.3. Domain registrations on automatic renewal may be eligible for a refund up to 29 days from the date of renewal. Newly purchased domain registrations constitute final sales and are not eligible for a refund.
Discounts & Termination
4.4. Services purchased with a discount of 49% or higher constitute final sales and are not eligible for a refund, subject to the SLA.
4.5. Services with past-due payment(s) will be suspended after 7 days and permanently terminated (with all associated data deleted) on the 15th day after the payment due date.
Refund Policy
4.6. Refunds are available within the first 30 days of the initial purchase of a service, subject to Section 4.7.
4.7. Refunds will only be issued if:
- a. You contact our support team via the Website ticketing system or official Discord channel;
- b. The issue cannot be resolved within a 24-hour period from the time the support ticket is created; and
- c. The service does not qualify as a final sale under Sections 4.3 or 4.4.
5. Content
5.1. You are solely responsible for all content that you upload, post, email, transmit, or otherwise make available via the Services, including text, images, audio, video, software, and data (the “Content”). By using the Services, you represent and warrant that:
- a. You have all necessary rights, licenses, and permissions to the Content;
- b. The Content does not violate any laws, regulations, or third-party rights; and
- c. The Content does not violate these Terms.
5.2. Four Seasons Hosting reserves the right, but not the obligation, to monitor any Content and to remove any Content that, in its sole discretion, violates these Terms, applicable laws, or is otherwise objectionable.
6. Prohibited Uses
You may not use the Services to:
- 6.1. Make available Content that is unlawful, harmful, threatening, abusive, harassing, defamatory, obscene, invasive of privacy, hateful, or otherwise objectionable;
- 6.2. Harm minors in any way, including uploading or distributing child sexual abuse material or soliciting personal information from minors;
- 6.3. Impersonate any person or entity or misrepresent your affiliation with a person or entity;
- 6.4. Send unsolicited or unauthorized advertising, “junk mail,” “spam,” “chain letters,” or “pyramid schemes”;
- 6.5. Transmit viruses, Trojan horses, worms, corrupted files, or any code designed to disrupt or damage software, hardware, or networks;
- 6.6. Interfere with or disrupt the Services or connected networks, or disobey the policies of connected networks;
- 6.7. Consume excessive system resources, including CPU, memory, network bandwidth, and disk space, outside your plan’s fair-use allowance;
- 6.8. Exploit, harm, or attempt to exploit or harm minors in any way; or
- 6.9. Violate any applicable local, state, national, or international law or regulation.
7. Terms Modifications & Changes to Services
7.1. Four Seasons Hosting reserves the right to revise, modify, or update these Terms at any time in its sole discretion. All changes are effective immediately upon posting to the Website.
7.2. Your continued use of the Services following the posting of revised Terms constitutes acceptance of the changes. You should check this page periodically.
7.3. For material changes, we will make reasonable efforts to provide notice through the Website or via email to the address associated with your account.
7.4. Four Seasons Hosting reserves the right to modify, suspend, or discontinue any part of the Services at any time, with or without notice.
8. Limitation of Liability
8.1. To the maximum extent permitted by law, in no event shall Four Seasons Hosting, its affiliates, directors, employees, agents, partners, or suppliers be liable for any damages whatsoever — including direct, indirect, special, consequential, punitive, or incidental damages, or damages for loss of use, profits, or data — arising out of or related to:
- a. Your use of or inability to use the Services;
- b. Unauthorized access to or alteration of your Content;
- c. Any third-party content, statements, or conduct;
- d. Any viruses or disabling features that affect your use of the Services;
- e. Any service interruptions or delays; or
- f. Any other matters relating to the Services.
8.2. The foregoing limitation applies whether based on warranty, contract, tort, negligence, strict liability, or any other legal theory, and whether or not we were advised of the possibility of such damages.
8.3. In jurisdictions that do not allow the exclusion or limitation of liability for consequential or incidental damages, our liability shall be limited to the maximum extent permitted by law.
9. Disclaimer of Warranties
9.1. The Services are provided “as is” and “as available” without warranty of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
9.2. Four Seasons Hosting does not warrant that the Services will be uninterrupted or secure, that defects will be corrected, that the Services are free of harmful components, or that results will meet your requirements.
9.3. We specifically disclaim any warranties regarding third-party applications, software, or services accessed through the Services.
10. Indemnification
10.1. You agree to defend, indemnify, and hold harmless Four Seasons Hosting, its affiliates, licensors, and service providers, and their respective officers, directors, employees, contractors, and agents, from any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to:
- a. Your violation of these Terms;
- b. Your Content;
- c. Your use of the Services;
- d. Your violation of any third-party right, including any intellectual property, publicity, or privacy right; or
- e. Any claim that your Content caused damage to a third party.
10.2. This defense and indemnification obligation will survive these Terms and your use of the Services.
11. Your Privacy
11.1. Four Seasons Hosting respects your privacy. Our Privacy Policy, incorporated into these Terms by reference, explains how we collect, use, and disclose your information.
11.2. The Privacy Policy can be accessed at fourseasonshosting.com/legal/privacy-policy. By using the Services, you agree to the collection and use of information in accordance with it.
11.3. You acknowledge and agree that your personal information may be processed in accordance with the Privacy Policy.
12. Governing Law & Dispute Resolution
12.1. These Terms and your use of the Services shall be governed by and construed in accordance with the laws of the State of Ohio, without giving effect to conflict-of-law principles.
12.2. Any legal action relating to your use of the Services shall be instituted exclusively in the federal or state courts located in Ohio.
12.3. You agree to submit to the jurisdiction of, and agree that venue is proper in, these courts.
12.4. Prior to initiating any legal action, you agree to attempt to resolve any dispute through informal negotiation by contacting Four Seasons Hosting at support@fourseasonshosting.com within thirty (30) days of the dispute arising.
13. Lifetime Packages
13.1. “Lifetime” packages (also offered as “Infinite” or “Lifelong” products) require a one-time payment rather than a recurring fee, and grant the right to use the specified product for its operational lifetime, subject to this section.
13.2. “Lifetime” means the operational lifetime of the relevant Four Seasons Hosting product or of Four Seasons Hosting itself — not your own lifetime. A Lifetime package is not a promise of perpetual operation.
13.3. We may discontinue a Lifetime package if Four Seasons Hosting ceases to operate or the product can no longer reasonably be provided. Where practicable, we will give reasonable notice before doing so.
13.4. The voluntary refund promise in Section 4.6 does not apply to Lifetime packages. Your statutory rights remain unaffected.
14. Email Sending
14.1. Port 25 is closed by default across our network, and outbound mail is disabled on virtual and cloud servers. Customers who need to send mail should route it through an external SMTP relay such as Amazon SES. Web hosting accounts, by contrast, can send outbound mail without any additional steps.
14.2. Where you have a legitimate reason to send mail directly from a server, you may request that port 25 be opened by submitting a support ticket that provides:
- a. the address of the website or project the mail relates to, where one exists;
- b. a description of why port 25 access is needed; and
- c. a summary of the kinds of messages you intend to send.
14.3. Once port 25 has been opened, any account we determine to be sending spam or otherwise abusive mail will have the port closed again, and we will decline every further request to reopen it — both on that account and on any other service you hold now or acquire in the future. The only accounts eligible for an exception are resellers and customers running multi-user environments, such as web hosting platforms.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms otherwise remain in full force and effect.
16. Assignment
These Terms are not assignable, transferable, or sublicensable by you without our prior written consent. Four Seasons Hosting may assign, transfer, or delegate any of its rights and obligations under these Terms without your consent.
17. Entire Agreement
These Terms, together with the Privacy Policy, Acceptable Use Policy, Service Level Agreement, and any other legal notices published by Four Seasons Hosting, constitute the entire agreement between you and Four Seasons Hosting concerning the Services.
